21. The Independent Parking Committee

The Independent Parking Committee is the newest Accredited Trade Association in the Private Parking Sector. Offering a fresh approach to the industry, striving to promote a fair balance between the landowner/parking operators and the motorist.​

Members will benefit from the IPC's Code of Practice, which provides a model for good practice within the off-street parking industry. The IPC's Accredited Trade Association Status allows members who subscribe to the Accredited Operator Scheme to make appropriate applications for vehicle keeper details from the DVLA once membership to IPC has been approved and the Code of Practise has been implemented. IPC’s rigorous audit process ensures operators get it right from the outset before having accredited status.

The Code of Practice has been created with reference to the relevant legal principles that govern the private parking industry and with particular reference to the Protection of Freedoms Act which created a mechanism which ensures that properly issued parking charges are ultimately enforceable.

The IPC's Code of Practice was created as a guide to Operators/Landowners to assist them to act appropriately in order that resulting charges that are issued are done so lawfully and are therefore enforceable.

Independence guaranteed​

We guarantee that the appellants appeal will be considered by a completely independent and impartial adjudicator. Whilst the Appeals System is administered by the IPC, each appeal is dealt with by a qualified and practising solicitor or barrister who will consider written representations from the appellant and the Parking Operator before deciding whether the charge was lawfully issued. Adjudicators are appointed under a contract of self-employment and it is an express term of their appointment that they must retain complete impartiality. They are not permitted to be influenced by the IPC and must not exercise any bias towards either the Parking Operator or the Motorist. They can only consider the lawfulness of a charge and cannot consider mitigating circumstances. Although the IPC works in association with Gladstones Solicitors, Gladstones Solicitors do not consider appeals. Trading Standards Institute, under The Alternative Dispute Resolution for Consumer Disputes Regulations 2015, have introduced ADR to all industries which includes parking. The IPC is an accredited ADR provider, members of the BPA will be able to use the IAS ADR process as POPLA is not accredited as an ADR provider.
